Terms and Conditions

1. Who we are
These Terms and Conditions (“Terms”) govern your access to and use of the website located at editions.acd.com.au (the “Site”) and the digital newspaper archive and subscription services offered on it (the “Service”), operated by Australian Chinese Media NSW Pty Ltd , ABN 43 200 149 716 (“we”, “us”, “our”).
By creating an account, purchasing a subscription, or otherwise using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
2. The Service
The Service provides access to digitised editions of Australian Chinese Daily and related publications (“Content”) in a digital flipbook format. Access to some or all Content requires an active paid subscription.
We may add, remove, or change the Content available, the format in which it is delivered, or the features of the Service at any time, acting reasonably.
3. Accounts
3.1 You must create an account to purchase a subscription. You agree to provide accurate, current information and to keep your login details confidential.
3.2 You are responsible for all activity that occurs under your account. Notify us immediately at [support email] if you suspect unauthorised use.
3.3 We may suspend or terminate an account that we reasonably believe is being used fraudulently, shared beyond what these Terms permit, or in breach of these Terms.
4. Subscriptions, billing, and renewal
4.1 Subscriptions are billed on a recurring basis (e.g. weekly/monthly/annually, as selected at purchase) at the price displayed at the time of purchase.
4.2 Automatic renewal. Your subscription will automatically renew at the end of each billing period and your payment method will be charged automatically, unless you cancel before the renewal date in accordance with clause 5.
4.3 Limit of one active subscription. Each customer may hold only one active subscription at a time. Purchases are limited to one subscription item per order.
4.4 Price changes. We may change subscription prices from time to time. Any price change will apply from your next renewal after the change takes effect, and we will give you reasonable notice beforehand (e.g. [7 days’] notice by email) so you can cancel before being charged the new price if you do not agree to it.
4.5 Payments are processed by various reputable payment gateways like Stripe, Paypal, Apple Pay, Google Pay, etc. We do not store your full payment card details.
5. Cancellation
5.1 You may cancel your subscription at any time from your account dashboard, or by contacting us at editions@acd.com.au. Cancellation takes effect at the end of the current paid billing period — you will retain access until that period ends, and will not be charged again.
5.2 We may cancel or suspend your subscription if you breach these Terms, or if we cease to offer the Service, with notice where reasonably practicable.
6. Refunds
6.1 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (or any other law) that cannot lawfully be excluded. Where the Australian Consumer Law applies and the Service fails to meet a consumer guarantee, you may be entitled to a refund, replacement, or other remedy regardless of anything else stated in this clause.
6.2 Subject to clause 6.1, and except where required by law, subscription fees already paid are non-refundable, including for partial billing periods.
6.3 If you believe you have been incorrectly charged, contact us at editions@acd.com.au within 7 days and we will investigate.
7. Intellectual property
7.1 All Content, including newspaper editions, articles, images, and the flipbook presentation itself, is protected by copyright and other intellectual property laws and is owned by us.
7.2 Your subscription grants you a personal, non-exclusive, non-transferable licence to view the Content for your own personal use while your subscription is active. You may not:
- reproduce, redistribute, sell, sublicense, or publicly display Content;
- share your account credentials with any other person;
- use automated tools to scrape, download, or bulk-copy Content;
- remove any copyright or proprietary notices from the Content.
7.3 Access to Content ends when your subscription ends, including if it lapses due to non-payment or cancellation.
8. Acceptable use
You agree not to use the Site to: breach any law; infringe another person’s rights; upload or transmit malicious code; attempt to gain unauthorised access to the Site or other users’ accounts; or interfere with the proper functioning of the Site.
9. Availability and changes to the Service
We aim to keep the Site available but do not guarantee uninterrupted or error-free access. We may suspend the Site for maintenance, and may modify or discontinue features of the Service, with reasonable notice where the change is material.
10. Limitation of liability
10.1 To the maximum extent permitted by law, and subject to clause 6.1, we exclude all liability for indirect or consequential loss arising from your use of the Site or the Service.
10.2 Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the Service or refunding the amount you paid for the relevant subscription period.
10.3 Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot lawfully be limited or excluded.
11. Privacy
Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you (e.g. by email or a notice on the Site) before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State/Territory.
